This Privacy Policy describes how AiCHEMIST collects, uses, stores and protects the personal data of its users, clients and website visitors.
The data controller is Gustavo Marioni (hereinafter, «AiCHEMIST» or «the Controller»), domiciled in the City of Buenos Aires, Argentina. Contact: gustavomarioni@gmail.com.
This policy applies to the aichemist.solutions website, its subdomains, and all services, products and platforms operated under the AiCHEMIST brand.
Personal data processing is governed by the following regulations, depending on the user's jurisdiction:
— Argentina: Law No. 25,326 on Personal Data Protection and its implementing regulations (Decree 1558/2001).
— Chile: Law No. 19,628 on the Protection of Private Life, for clients or users domiciled or primarily active in Chile.
— International: For European Union users, AiCHEMIST applies the principles of the GDPR (EU Regulation 2016/679) as a best-practice standard.
AiCHEMIST collects only the data necessary to deliver its services. Data collected includes:
a) Contact and identification data: name, surname, email address, phone number, company, job title.
b) Navigation and usage data: IP address, browser type, pages visited, session duration.
c) Business and tax information: tax ID, tax status, billing details.
d) Platform Inputs: data, files, digital assets or other content uploaded by the User within AiCHEMIST services. See Section 05 for specific processing details.
e) Communications: email records, support requests and conversations with the AiCHEMIST team.
Collected data is used exclusively for the following purposes:
— Service delivery: operating, maintaining and improving AiCHEMIST's platforms and solutions.
— Commercial and technical communication: sending proposals, product updates and responses to inquiries.
— Invoicing and tax compliance: issuing receipts in accordance with applicable tax regulations.
— Service improvement: aggregated and anonymized analysis of platform usage to optimize features.
— Legal compliance: responding to requests from public or judicial authorities where legally required.
AiCHEMIST does NOT use personal data for: (i) sale to third parties; (ii) third-party advertising; (iii) AI model training without explicit prior consent.
This section is especially relevant for clients who use AiCHEMIST services to process data belonging to their own clients or audiences (e.g. Agentic DAM, Synthetic Customer, PMO AI, Loyalty Programs).
Controller role: AiCHEMIST acts as Data Controller for data it collects directly from its own users and clients for commercial and operational management.
Processor role: When a client uploads data belonging to third parties, AiCHEMIST acts exclusively as a Data Processor:
— The AiCHEMIST client is the Data Controller vis-à-vis their own users and under applicable law.
— AiCHEMIST accesses such data only to the extent strictly necessary to deliver the contracted service.
— AiCHEMIST does not reuse, share or process such data for its own or third-party purposes.
— The client is responsible for having the legal bases and consents required for the processing they entrust to AiCHEMIST.

AiCHEMIST as CONTROLLER
Data collected for its own commercial operation: contacts, clients, billing, website navigation.
AiCHEMIST as PROCESSOR
Data the client uploads for AI processing (DAM, Synthetic Customer, PMO AI, Loyalty). The client is the Controller under the law.
To deliver its services, AiCHEMIST uses third-party technology infrastructure that may be located outside Argentina:
— AI model providers (OpenAI, Anthropic, Google DeepMind, among others): may process User Inputs to generate responses or complete agentic tasks.
— Cloud infrastructure (Vercel, Firebase/Google Cloud, AWS): hosting, database and storage.
— Web analytics tools: Google Analytics or equivalent, to measure site usage in aggregate form.
AiCHEMIST selects providers offering adequate data protection guarantees. No international data transfers are made for commercial purposes of AiCHEMIST's own.
The AiCHEMIST website uses cookies and similar technologies to ensure proper functioning and improve user experience.
— Technical cookies (necessary): essential for site operation. Do not require consent.
— Analytical cookies: enable aggregated, anonymized measurement of traffic and user behavior. Users may disable them without affecting site functionality.
— Marketing / third-party cookies: AiCHEMIST does not actively use third-party advertising tracking cookies.
AiCHEMIST retains personal data for the time necessary to fulfill the described purposes, with the following periods:
— Active client data: throughout the duration of the commercial relationship.
— Tax and billing data: up to 10 (ten) years, in accordance with Argentine tax obligations.
— Contact data and communications: up to 5 (five) years from last contact.
— Navigation data and cookies: maximum 24 (twenty-four) months.
— Platform Inputs: up to 90 days after project completion, after which they are securely deleted.
AiCHEMIST implements reasonable technical and organizational measures to protect personal data:
— Encrypted communications via HTTPS/TLS on all interactions with the site and platform.
— Secure credential authentication and, where applicable, multi-factor authentication.
— Access restricted according to the principle of least privilege.
In the event of a security breach that may affect personal data, affected parties will be notified as soon as possible and corrective measures will be adopted.
Under Law 25,326 and applicable regulations, data subjects have the right to:
— Access: knowing what personal data AiCHEMIST holds about them.
— Rectification: correcting inaccurate, incomplete or outdated data.
— Erasure: requesting deletion of their data, unless there is a legal obligation to retain it.
— Objection: objecting to processing for certain purposes, particularly commercial communications.
— Portability (for GDPR users): receiving their data in a structured, machine-readable format.

AiCHEMIST services are directed exclusively to individuals over 18 years of age and to legally constituted organizations.
AiCHEMIST does not intentionally collect personal data from minors. If such data is detected, it will be immediately deleted.
AiCHEMIST may update this Privacy Policy to reflect changes in its practices or applicable regulations. Modifications will be published on this page with the date of last update.
For material changes, proactive notification will be sent by email to active users at least 15 (fifteen) days in advance.
